Terms and Conditions

Vervet Opplevelser AS/Vervet Adventures with registered office at Nordøstpassasjen 47, 9008 Tromsø, Norway, acts as an agent in order to provide travel services in Norway. Read these terms and conditions for booking carefully and make sure you understand and abide them.

Vervet Adventures operates as an agent/reseller, working with Service Providers to offer their services. When you make a booking through Vervet Adventures, it's important to understand that the Terms and Conditions presented here, in addition to the specific booking conditions and Terms and Conditions of the Service Provider, apply to your reservation. We strongly recommend carefully reviewing these terms, as the Service Providers may have their own limitations on liability.

When renting a stand-up paddle board, Vervet Adventures is the product owner. See specific terms and conditions for SUP rental at the bottom of these terms and conditions.

Please note that any claims related to the activities you book should be directed towards the respective Service Provider. It is the responsibility of the Service Provider to ensure that the activity aligns with your booking.

Vervet Adventures is responsible for forwarding your booking to the appropriate Service Provider and ensuring that you receive all the necessary information prior to your activity. In the event of significant changes or the cancellation of your booking, the Service Provider will get in touch with both us and you, and Vervet Adventures will manage the cancellation process accordingly.

Booking

By making a booking, the first named person/lead participant on the booking or the person making the booking agrees on behalf of all persons detailed on the booking that you:

1. You've read and agree to these Terms and Conditions.

2. You have provided accurate information and requisite details in the booking.

3. You're agreeing with us using personal data per our Privacy Policy and can share others' details, including sensitive data if needed (such as health conditions and disabilities).

4. You're at least 18 years old, and should age restrictions be applicable to the booking, you hereby confirm that both you and any other involved parties meet the required age criteria.

5. You're responsible for paying for everyone on the booking.

Booking confirmation

Your reservation is confirmed when payment is done, and you have received the booking confirmation to your email. Check it immediately. If you spot errors, let us know right away because changes may not be possible later.

Payment and security

Payment is processed at the time of the booking. Full Payment for the selected overnight stay(s) and/or activity(s) needs to be done prior to the start of the overnight stay(s) and/or activity(s). Vervet Adventures is responsible for the transaction and to ensure accurate card charges. Should any issues arise with your credit card, we will promptly contact you. Failure to establish contact will result in the cancellation of your booking. All personal data is handled on an external encrypted site for maximum security. Vervet Adventures and the Service Provider(s) will have access to your name and contact details. This information is used to notify you of any alterations or cancellations and may also be used for conducting market surveys. Your credit card information is not shared with us, but with our payment provider NETS/NETS Easy for a secure payment.

Cancellation/alterations by you

If you wish to cancel or alter your arrangements after your booking has been made, we will do our best to arrange this and, if possible, make these changes. Any request for changes or cancellations must be made in writing by the person who made the booking to booking@vervetadventures.no. This must include the booking reference number and the name on the booking. For cancellations 7 days or less prior to your scheduled arrival/tour/activity, please contact both the Service Provider and us. Any changes made by you are regarded as a cancellation, and the cancellation policy deadlines applies.
*Read special cancellation conditions from some of the suppliers of tours below.

Cancellation policy – 14 pax or less:

1. More than 7 days to departure: No cancellation fee.

2. 7 days or less to departure/no show: No refund.

Cancellation policy – 15 pax or more:

1. More than 30 days: No cancellation fee.

2. 30 to 15 days: 50% of the total price will be charged.

3. 14 days or less/no show: No refund.

*Adjustments in the final group size for a maximum of 3 persons can be made up to 14 days prior to the groups' arrival. Any adjustments in the final group size after the 14 days will be charged 100%.

Cancellation policy Hermes II AS:

1. 8 days or more to departure: No cancellation fee.

2. 7-3 days to departure: 50% of the total price will be charged.

3. 0-2 days to departure/no show: No refund.

Cancellation policy The Green Adventure:

A handling fee is necessary to be able to offer the tours for reasonable price and cover the costs of financial operations of their partners.

1. Individual bookings: a handling fee of NOK 150 per person will be deducted from the refund.

2. Private tours 1-8 people: a handling fee of NOK 1200 will be deducted from the refund.

3. Private tours 8-15 people: a handling fee of NOK 2400 will be deducted from the refund.


Some Service providers have other terms and conditions than those mentioned above. These will be displayed at the time of the booking.

Late arrival policy

If you miss your transport arrangement, contact the Service Provider right away to see what can be done. No refunds for no-shows or late cancellations. We're not responsible for your late arrival due to traffic, accidents, weather, etc..

Cancellation/alterations by us

Tours can be changed/cancelled due to:

1. Conditions beyond our Service provider’s control: e.g. weather (the Service Provider determines whether such conditions apply), accidents, breakdowns, strikes, etc.

2. Conditions for the booking have not been fulfilled: minimum number of participants, age, etc.

For a better experience, we may need to change or cancel your booking anytime, and if such change is done by the Service Provider, we will help with the change of the booking or handle the cancellation.

Refunds

Vervet Adventures is responsible for the refund process. After receiving your cancellation email, Vervet Adventures will verify the cancellation and respond accordingly. If your cancellation falls within the specified timelines according to our cancellation policy that entitle you to a refund of the entire or partial booking fees, we will then request your banking details to facilitate the refund process.

Vervet Adventures will require a minimum of seven (7) working days to process and issue refunds after receiving your cancellation email.

We process refunds in Norwegian Kroner (NOK). Your bank converts it to your card's currency, and the amount may vary due to daily exchange rate changes. Vervet Adventures isn't part of this exchange process and is not accountable for any loss incurred. Please note that Vervet Adventures does not cover bank fees for international transfers, and these fees will be deducted from the refund.

Insurance and cancellation protection

We strongly recommend all guests to protect yourself against any financial loss by getting a trip cancellation insurance in case of illness, lost luggage, accident, liability, etc. You are also responsible for obtaining full travel and health insurance for yourself, and ensure that all individuals on whose behalf the booking is made have also obtained the necessary insurance coverage.

The Service Provider will send an email/SMS to all participants if an activity is cancelled due to unforeseen reasons or bad weather. You will be given a full refund if it is not possible to change the tour to a later date.

The Service Provider(s) reserves the right to deny access to their activities to guests who are physically and/or mentally unfit, posing a potential safety hazard to others. If these conditions are not met, the activity leader retains the full authority to remove a guest from the activities. In such instances, we will not provide a refund or compensation.

Guarantees

Vervet Adventures nor the Service Providers can be held responsible for outcomes on tours dependent on weather and nature. This category includes experiences like northern lights excursions, whale watching tours, and other nature or wildlife sightseeing tours. Noone can guarantee sightings of northern lights, whales, or other natural phenomenon/wildlife. However, our Service Providers will use all their experience to fulfil the goal of the activity(s).

Medical issues and mobility in general

Prior to booking, it is essential to assess the nature of the overnight stay(s) and/or activity(s) and confirm your fitness to participate.

You are required to inform us in writing of any pre-existing physical or mental conditions that may necessitate specific medication or special equipment. It is your responsibility to bring the required medication and equipment for the overnight stay(s) and/or activity(s). Please be aware that not all overnight stay(s) and/or activity(s) are wheelchair accessible.

If you have any uncertainties about your physical or mental condition in relation to participation, we encourage guests to reach out to us for clarification. If the activity or overnight stay in question proves unsuitable, we are open to exploring alternative options that better fits your needs.

Our Service Providers

Vervet Adventures ensures that our Service Providers receive payment for the product(s) you book through us. Our Service Providers are responsible for ensuring that all aspects of their activity(s)/overnight stay(s), and adhere to current legislation and regulations applicable to them. This includes insurances, permits, equipment, staff, vehicles, etc.

The Service Provider(s) sets the price levels and age limit discounts applicable for their activity(s)/overnight stay(s). The Service Provider(s) also decides the age restrictions for participation on their activity(s)/overnight stay(s) depending on how they can accommodate for this and for safety reasons.

Claims and complaints

If you encounter issues with your travel documents that cannot be immediately resolved, we kindly request that you get in touch with us upon your return using the contact information provided in your confirmation documents. Failing to do so may impact your potential compensation, which could be reduced or even nullified in certain situations.

It's important to understand that any claims or grievances pertaining to specific products should be directed to the respective Service Provider. Vervet Adventures is not accountable for individual products; our role is to facilitate your booking with the Service Provider, who bears the responsibility for ensuring that the activity, accommodation, or rental equipment aligns with your booking. The Service Provider is also responsible for maintaining safety standards and delivering the product in accordance with the provided description.

Vervet Adventures will promptly address any claims or complaints from you regarding the provided services. Such concerns should be brought to our attention as soon as possible, but no later than 7 days from the occurrence of the event that gives rise to the claim or complaint. It is essential that the claim or complaint includes adequate details and available evidence for Vervet Adventures to present the claim/complaint to our Service Provider(s).

Additionally, for boat or car trips where motion sickness may occur, we nor the Service provider are not responsible for this, and participants are advised to take necessary precautions. Motion sickness remedies, such as pills, can be obtained from local pharmacies as a preventive measure.

Terms and conditions stand-up paddle rental

The general terms and conditions apply to rental of stand-up paddle (SUP) boards. In addition, the following terms and conditions applies:

1. You must be over 18 years old and know how to swim.

2. Children over 10 years old can use the board with parental consent and supervision.

3. SUP activities should not be practiced more than 150 meters from the shoreline.

4. It is not allowed to rent the board in a state of intoxication. The lessor reserves the right to cancel the rental for individuals who are obviously intoxicated.

5. The participant(s) must be in sufficient health to practice SUP and water sports in general.

6. Weight limitations of the boards must be respected.

Renters’ responsibilities and duties:

1. All use is at the user's own risk.

2. The renter is responsible for familiarizing themselves with and adhering to local guidelines and rules for the use of SUP boards. This includes always wearing a CE-approved life/paddle vest when using the SUP board which is mandatory by Norwegian Law.

3. Be considerate of your surroundings (including other people and animals).

4. Be cautious of weather conditions, particularly wind. Avoid paddling in strong winds or adverse weather conditions that could pose risks to your safety. Always check weather forecasts before heading out and consider postponing or going to a more weather protected area for the day of your SUP rent.

5. The renter is advised to have a travel and accident insurance for themselves and the rented items.

6. Do not exceed 1 adult and 1 child per board, and make sure that the board has sufficient weight capacity to support the combined weight. Never exceed the weight capacity of the SUP board.

7. Do not leave the equipment unattended and take care of the equipment as it was your own. Replacement of lost or damaged equipment will be invoiced according to the price list below. Normal wear and tear does not contribute to liability for compensation. Tears, scratches, cuts, and other damage due to improper/careless use will be charged for repair or replacement if necessary.

8. The renter must report faults, damages, or deficiencies as soon as possible after detecting the fault/damage. Take a picture of the damage and reach out by phone or email (can be found in the booking confirmation). After you have completed the damage report, return the board to us and we will refund the rental fee. If possible, and the renter wants to reschedule the rental period to a different date, we will accommodate for that.

9. Return the equipment by the agreed-upon time. Late returns will incur an additional fee, and the renter is responsible for all losses incurred by the lessor due to late return, even if they are not personally at fault.

10. If the equipment is damaged or lost during the rental period, you must notify us when returning the equipment. In the event of damage to rental equipment, the renter will be charged the cost of repairing/replacing the equipment.

11. Subleasing or lending to others without the lessors consent is not permitted.

Charges for delayed delivery, or replacement of damaged or lost equipment:

• Late delivery fee of NOK 199 per hour per board.
• Lost or damaged fin or safety leash NOK 400 (each).
• Lost or damaged pump or SUP bag NOK 600 (each).
• Lost or damaged paddle or life vest NOK 900 (each).
• Lost or damaged board NOK 6000.

Lessors’ responsibilities and duties

1. The lessor is obliged to have the equipment available in good condition at the time of the rental.

2. All use of our services is at the customer’s and participants’ own risk. The lessor is not responsible for any damages incurred in connection with the service, neither to the renter, participant, nor third party. This includes transportation of the equipment.

3. Compensation for damaged or not available equipment at the time of the rental corresponding to the cost of the rental.


Jurisdiction

Vervet Opplevelser AS/Vervet Adventures is a Norwegian company and operate under Norwegian Law. All aspects of these terms and conditions and any agreements to which they pertain are subject to Norwegian law. Both parties mutually consent that any disputes, claims, or other matters arising between us concerning your contract or booking will be addressed and resolved in the local court of Nord-Troms Tingrett in Tromsø, Norway.
